**GRUPO FASYL SAS,** a commercial entity legally established under the laws of the Republic of Colombia, identified with NIT. 900918131-2 and headquartered at carrera 12 No. 3D-02 in the municipality of Zipaquirá, as documented in the certificate of existence and representation from the Chamber of Commerce of Bogotá.

**GRUPO FASYL SAS** owns the commercial establishment called Viaje Fasyl, a tourism operating agency with RNT 99632, and the Ecotourism Park Santuario Chiquito in partnership with APPPA (Association of Producers and Protectors of Páramo and Water).

The websites www.viajefasyl.com.co and www.viajefasyl.com aim to provide information about the services, experiences, and promotions offered by **GRUPO FASYL SAS** through these sites.

**GRUPO FASYL SAS** reserves the right to modify and/or update the content/configuration and/or presentation of the website at any time.

**PREAMBLE**

These General Sales Conditions (“Terms and Conditions”) shall apply between the company **GRUPO FASYL SAS COLOMBIA, S.A.S** (hereinafter “GRUPO FASYL SAS”) and any person making a purchase (hereinafter “the Internet User”) through the websites www.viajefasyl.com.co and www.viajefasyl.com, collectively referred to as “the Parties.”

The Parties agree that their relations shall be governed exclusively by these General Sales Conditions, which are accessible on the websites www.viajefasyl.com.co and www.viajefasyl.com, and must be previously accepted by the customer in any case.

In the event of modification by GRUPO FASYL SAS, the conditions applicable to each Internet User will always be those accepted at the time of making their purchase.

The Internet User, prior to contracting and throughout the purchase process, may access, archive, and print these general terms and conditions for reference.

**ARTICLE 1: SALES PROCEDURE**

The Internet User declares to be eighteen years of age or older and to have the legal capacity to assume obligations, especially to make a purchase on the websites www.viajefasyl.com.co and www.viajefasyl.com.

Minors must refrain from registering or making purchases. The Internet User undertakes to respect these General Sales Conditions.

The purchase through www.viajefasyl.com.co and www.viajefasyl.com is governed by the conditions of the experiences. The intention of **GRUPO FASYL SAS Colombia** is to reach as many customers as possible. Based on this, to carry out an excellent experience, each activity has a limit of 15 participants per day.

The purchase is made, in compliance with the parameters described in the preamble, following the steps described below:

1. Access www.viajefasyl.com.co and/or www.viajefasyl.com and connect to the store.
2. You have several possibilities to find an experience:

– Use our search engine.
– Select the location and type of experience you want. Once you have found the activity of your preference, click on the photo to discover the service in detail. Once on the chosen tour’s tab, select the date, number of people (adults and children). Then click on the “Add to Cart” button. If you want to continue shopping, click on the “Continue shopping” button. If you want to finish shopping and validate your order, click on the “Proceed to payment” button.

3. Shopping Cart

You can view the selected services in the shopping cart, where you can modify quantities or remove unwanted services. If you want to complete the purchase, click on the “Proceed to payment” button.

4. Identify Yourself

– If you are a registered user, enter your email and password and click on “Connect.”
– If you are a new customer, access the “register” option, select the country from which you are making the purchase. Then enter your email, cell phone number, type of document and identification, and finally, generate a password for your account.
– Finally, read the “Terms and Conditions” and select whether you agree with them and proceed with the payment.

5. Proceed with Payment

Check the summary of your order and the total price of your purchase. Then select the payment button that will redirect you through a secure connection to our payment gateway.

On the screen, you can choose your preferred payment method among the following:

– Card: Credit or debit card Visa and MasterCard for any amount.
– Cash: Efecty, Vía Baloto, Paga Todo.
– Bank deposit.
– P.S.E.

If your payment method is a credit or debit card, enter your banking details and validate. You will simultaneously receive a response from the bank confirming or rejecting the transaction.

Once the payment is validated, made through any of the payment methods, the reservation of your experience will proceed.

Select the “Return to Store” button to close the secure connection and return to the website www.viajefasyl.com.co and/or www.viajefasyl.com.

Next, you will receive an email informing you when your order has been confirmed, and later, you will receive a call where you will be given instructions to carry out the experience in the most detailed way.

The acceptance of the transaction will be explicit, unequivocal, and verifiable by the competent authority, without prejudice to the right to cancel the transaction before it is concluded. Under no circumstances is the consumer’s will presumed, or their silence considered as consent, when this results in expenses or obligations on their part.

**Policy for Changes and Cancellation of Purchases through the GRUPO FASYL SAS website**

A policy of changes and returns is established on the following terms:

To make a change, you can:

– Go to our physical store, or
– Call (1) 851 8400 and inform the advisor of your desire to change the experience.
– Send an email to reservas@viajefasyl.com

The deadline for changing or returning money due to the cancellation of purchased tours, both online and in physical stores, for multi-day tours is fifteen (15) days before the selected date of the experience. In case of cancellation, if it is not done within the established period, 65% of the money will be refunded. Regarding Day Passes, the deadline for changes is 24 hours before the selected date of the experience, and in case of cancellation if it is not done within the established period, 65% of the

money will be refunded.

For both types of services, the date of purchase and the purchase amount must be indicated, or alternatively, by presenting the purchase invoice.

To proceed with the refund of your purchase:

– When the purchase is made with Credit Cards, the amount will be reimbursed within a maximum of 15 business days.
– When the purchase is made in cash or through PSE, the refund will take 24 hours.

**Electronic Invoicing**

In case the Internet User wishes to receive electronic invoicing for their purchases on the websites www.viajefasyl.com and www.viajefasyl.com.co, they must request it at the email reservas@viajefasyl.com.

**ARTICLE 2: THE SERVICES**

The websites www.viajefasyl.com and www.viajefasyl.com.co aim to accurately represent the characteristics of the services. However, external factors such as weather conditions may affect the activities. Therefore, the Internet User, in the exercise of their duty, is obliged to continue with the proposed activities.

**GRUPO FASYL SAS** guarantees the fulfillment of its temporary, joint (if applicable) obligation to respond to the effectiveness of its service and its conformity with the conditions of suitability, quality, and legally required safety or those offered without additional consideration to the product price, in accordance with Law 1480 of 2011 and other related regulations, applicable in each case.

**ARTICLE 3: PRICES**

The prices set on the websites www.viajefasyl.com and www.viajefasyl.com.co are indicated in Colombian pesos, including VAT in each of them. The prices are shown excluding any additional charges, which will be duly informed.

The retail price of the service will always be indicated at the time the Internet User has completed the shopping cart, and the customer will be informed of the final price of their purchase before validating the payment.

Before the completion or termination of the purchase, a summary of the order will be presented, including all the goods the customer intends to acquire, with their complete description, the individual price of each of them, the total price of the goods or services, and, if applicable, the costs and additional expenses to be paid for any other concept. This summary will allow verifying that the operation reflects the customer’s intention to purchase the offered services and other conditions, and if desired, make any necessary corrections or cancel the transaction.

**ARTICLE 4: AVAILABILITY**

**GRUPO FASYL SAS** will inform, prior to acquisition, the availability of the corresponding product. Availability may vary between the start of the purchase process and its confirmation. If, for any reason, after confirming the purchase, the product is not available, **GRUPO FASYL SAS** will contact the customer to offer the most effective solution.

In the event that the confirmation of the purchase occurs for all selected products, **GRUPO FASYL SAS** will contact the Internet User via email, informing them of the purchased products, their individual price, as well as the transportation price and the status of the reservation. Once the purchase is formalized, the sales invoice will be available as a digital support, which can be consulted and downloaded by the customer through the “My Account” link.

If the confirmation of the purchase occurs partially due to the lack of availability of some selected tours, **GRUPO FASYL SAS** will contact the Internet User, informing them of the experiences finally affected by the purchase via email, phone, and/or through the update of the order in the customer’s personal space, which they can access by clicking on “My Account.” In this case, the Internet User will be given the following options:

– Change of the tour or wait for it for a period not exceeding 7 days.
– Full refund of the purchase.

If the confirmation of the purchase does not occur due to the lack of availability of all selected services, **GRUPO FASYL SAS** will inform the Internet User that their purchase cannot be made. This communication will be made by phone, email, and/or through the update of the order in the Internet User’s personal space, which they can access by clicking on “My Account.” In this case, the refund of the entire purchase amount will be made, following the deadlines established in the “changes and returns” section of this text.

**ARTICLE 5: RIGHT OF WITHDRAWAL AND PAYMENT REVERSAL**

The Internet User has the power to exercise the right of withdrawal established in Article 47 of Law 1480 of 2011, in which case the contract will be terminated, and the money that the Internet User has paid will be reimbursed.

The maximum term for exercising the right of withdrawal will be fifteen (15) days for multi-day tours and twenty-four (24) hours for Day Passes.

Similarly, under the terms of Article 51 of Law 1480 of 2011, the Internet User has the power to initiate payment reversal in the event that a credit card, debit card, or any other electronic payment instrument was used for payment, in cases of fraud or if it corresponds to an unsolicited operation.

For the payment reversal to proceed, within five (5) business days following the date on which the Internet User became aware of the fraudulent or unsolicited operation, the Internet User must file a complaint with **GRUPO FASYL SAS**. If applicable, the Internet User must notify the issuer of the electronic payment instrument used to make the purchase. The issuer, along with other participants in the payment process, will proceed to reverse the transaction to the buyer.

In the event of a dispute between **GRUPO FASYL SAS** and the Internet User arising from a complaint that is resolved by a judicial or administrative authority in favor of the provider, the terms set forth in Law 1480 of 2011 will be followed.

The exercise of the powers described will be subject to one of the following procedures:

1. Send an email to the address reservas@viajefasyl.com, providing the following information: the Internet User’s personal data and address, order number, and date of tour acquisition.
2. Use the “Contact Us” option on the website www.viajefasyl.com and/or www.viajefasyl.com.co.
3. Use the “My Account” section on the website, which can be accessed from the site.

From Monday to Friday, through the phone number (1) 851 8400 from 7:00 am to 4:30 pm, or Saturdays from 7:00 am to 1:00 pm.

Once the withdrawal statement or payment reversal request (as applicable) is received, **GRUPO FASYL SAS** will confirm its receipt to the Internet User by sending an email, proceeding in accordance with the terms established in Law 1480 of 2011.

The refund amount will be made through the same payment method following the terms established in the “changes and cancellations” section, unless the Internet User expressly indicates another form and this is agreed upon by **GRUPO FASYL SAS**.

**ARTICLE 6: RESPONSIBILITIES**

**GRUPO FASYL SAS** will not be responsible for any damages that may be caused to the Internet User through the use of the Internet network, such as viruses, among others.

**ARTICLE 7: LICENSE TO ACCESS THE SITE**

**GRUPO FASYL SAS** grants a limited license to access and use the website for the purpose of learning about the services offered and making desired purchases. In no case does this grant the right for the Internet User to upload or modify the contents of the website without the express authorization of **GRUPO FASYL SAS**.

This license does not allow any other use, particularly commercial, of the website or its content (experiences, descriptions, prices, data, software, sound extracts, graphics, images, photographs, etc.).

The integrity of the elements of this website, of any nature, is the property of **GRUPO FASYL SAS** and is protected by the corresponding intellectual and industrial property rights.

**ARTICLE 8: PROTECTION OF PERSONAL DATA**

For the account creation process on the **GRUPO FASYL SAS** website, as well as for the purchase process and any associated processes, such as exercising the right of withdrawal or requesting payment reversal, it is necessary to collect personal data from the Internet User.

Their data will be included in a file owned by **GRUPO FASYL SAS** and will be used for the formalization of the purchase made, to process and inform the status of the reservation, as well as to send, by any means, including electronic, information about services and promotions. In compliance with the provisions of Law 1581 of 2012, Decree 1377 of 2013, and the rules that modify, add, or repeal them, by accepting these Conditions, you give your prior, express, and qualified consent for your personal data to be collected, stored, used, transferred, and transmitted to **GRUPO FASYL SAS** Colombia.

This communication will be carried out in accordance with the terms established in the Privacy Policy (available on the website www.viajefasyl.com and/or www.viajefasyl.com.co). to offer, by any means (electronic or not), information about the services and promotions of **GRUPO FASYL SAS**, as well as to carry out promotion, marketing, advertising campaigns, offer commercial services such as the Loyalty Card, and commercial information, and to know all its customers, suppliers, employees, and related third parties.

This consent may be revoked at any time by letter or email addressed to the Personal Data Protection Officer, who will receive such requests at the email reservas@viajefasyl.com, with the subject “Personal Data Protection Officer.”

For the exercise of any right related to the protection of personal data, it will be attended to at the aforementioned email.

**ARTICLE 9: INTEGRALITY**

If one or more provisions of these General Terms of Sale are declared null and void under the application of a law, regulation, or after a firm judicial or administrative decision, the remaining provisions will retain their validity and scope.

The fact that one of the Parties has not demanded the application of any clause of these conditions permanently or temporarily cannot be considered in any case as a waiver of said clause.

**ARTICLE 10: REQUESTS, COMPLAINTS, AND CLAIMS**

The websites www.viajefasyl.com and/or www.viajefasyl.com.co, in accordance with the provisions of Law 1480 of 2011, have a Peticiones Quejas y Reclamos (PQR) [Requests, Complaints, and Claims] service through the “Contact Us” section or the email info@viajefasyl.com. The Internet User authorizes that the responses to the Requests, Complaints, and Claims be notified to their email, without prejudice to being carried out by another means.

**ARTICLE 11: APPLICABLE LAW AND JURISDICTION**

These General Terms of Sale are subject to Colombian law. Any dispute arising from this document will be submitted to the applicable laws and competent judges in accordance with Colombian law.
